Changes



1-Trademarks

Changes that might be recorded against a trademark registration may be categorized into the following two groups:


A- Changes within the trademarks in form of:

(i) alteration of goods and services;
(ii) alteration of a registered trademark;
(iii) voluntary cancellation of a registration.

Requirements:

a- Power of attorney, duly executed by the proprietor, notarized and legalized by the Iranian Consulate;

b- Original certificate of registration/renewal, as the case may be.


B- Changes in the ownership such as;

(i) change of name of the proprietor;
(ii) change of address of the proprietor;
(iii) assignment of the registration;
(iv) mergers;

Requirements

• Power of attorney, duly executed by the new proprietor, notarized and legalized by the Iranian Consulate;

• Deed of Assignment, duly executed by the assignor(s) and the assignee(s), notarized and legalized by the Iranian Consulate.

• Instrument of Change of Name/Address/Merger duly certified and legalized by the Iranian Consulate.

• Original certificate of registration/renewal, as the case may be.

The above changes must be officially recorded in Iran, a notice to that effect must be published in the Official Gazette (except for change of address) and they must be endorsed on the reverse side of the original certificate of registration/renewal, as the case may be.

2- PATENTS

Any change in the ownership of a patent granted in Iran such as change of name/address/merger or assignment of the patent rights must be officially recorded in Iran, a notice to that effect must be published in the Official Gazette (except for change of address) and must be endorsed on the reverse side of the Iranian letters patent.

The following changes may be effected against a granted Iranian patent:

• change of name of the proprietor;
• change of address of the proprietor;
• assignment of the registration;
• mergers;

Requirements

• Power of attorney, duly executed by the new proprietor, notarized and legalized by the Iranian Consulate;

• Deed of Assignment, duly executed by the assignor(s) and the assignee(s), notarized and legalized by the Iranian Consulate.

• Instrument of Change of Name/Address/Merger duly certified and legalized by the Iranian Consulate.

• Original letters patent for endorsement purposes.


3- Licenses

According to Article (19) of the Regulations of the Iranian Trademark & Patent Registration Act, where the owner of the mark or his legal representative grants another person the license to use that mark, this license will be valid if the License Agreement has been officially recorded in Iran. Where the licensor and the licensee sign the Agreement, its registration will be effected as per a written request of the owner of the mark or his authorized representative or the licensee.

Requirements

1. Copy of the License Agreement duly signed by both parties, notarized and legalized by the Iranian Consulate;
2. Power of attorney duly executed, notarized and legalized by the Iranian Consulate.
